3. Your Federal Consumer Rights — Free Alternative Disclosure
Federal law gives you specific rights to dispute inaccurate, incomplete, or unverifiable information on your consumer credit file. These rights are described in the federal Consumer Credit File Rights Under State and Federal Law notice, required by the Credit Repair Organizations Act, 15 U.S.C. § 1679c. The relevant statutes include, without limitation:
- Fair Credit Reporting Act (“FCRA”), 15 U.S.C. § 1681 et seq. — including § 1681i (consumer reporting agency reinvestigation duties) and § 1681s-2(b) (furnisher duties upon notice of dispute).
- Fair Debt Collection Practices Act (“FDCPA”), 15 U.S.C. § 1692 et seq. — including § 1692g (debt-validation rights).
- Credit Repair Organizations Act (“CROA”), 15 U.S.C. § 1679 et seq.
You have the right to dispute inaccurate information directly with the consumer reporting agencies and furnishers at no cost. You are not required to use Vindex Intelligence or any credit-repair organization to exercise these rights. The Consumer Financial Protection Bureau (“CFPB”) provides free resources and a complaint portal at consumerfinance.gov.
4. Your Right to Cancel (CROA, 15 U.S.C. § 1679e)
You may cancel your contract with Vindex Intelligence, without penalty or obligation, at any time before midnight of the third (3rd) business day after the date on which you signed the contract. To cancel, you must send a signed, dated written notice of cancellation to the address listed in your account settings, or use the in-app cancellation option. Upon timely cancellation, all fees you paid for services not yet performed will be refunded.
5. No Guarantee — Results Vary by File
Vindex Intelligence does not guarantee any specific result. Outcomes depend on factors that are individual to each Consumer, including but not limited to the accuracy of the underlying tradeline data, the age of the account, the cooperation of the furnisher, the responsiveness of the consumer reporting agency, the documentation in your possession, applicable statutes of limitation, prior disputes, and the strength of the legal basis for each dispute. Two consumers with similar-looking files may experience materially different outcomes. Past results of other consumers are not indicative of your results.
We do not promise that any specific item will be deleted, corrected, or updated; that your credit score will increase by any particular number of points; that any specific creditor will respond favorably; or that any particular timeline will be achieved.
6. Prohibited Conduct (CROA § 1679b)
You agree not to use the Service to make any statement that is untrue or misleading, or which should be known by you to be untrue or misleading, to a consumer reporting agency, creditor, or furnisher. You will not dispute information that you know to be accurate. You will not use the Service to alter your identity, obtain a new credit identity through an Employer Identification Number or any other means, or commit any act of fraud. Misuse of the Service may result in immediate termination of your account, forfeiture of fees, and referral to law-enforcement authorities.
7. Account, Authorization, and Electronic Signature
You authorize Vindex Intelligence to (a) generate dispute letters bearing your name, return address, and electronic or scanned signature; (b) prepare correspondence on your behalf for your review prior to mailing; and (c) store your credit-file data and dispute history for the purpose of providing the Service. You agree that an electronic or imaged signature you upload to the Service has the same legal effect as a handwritten signature under the federal E-SIGN Act, 15 U.S.C. § 7001 et seq.
8. Fees, Billing, and Refunds
Pricing is disclosed at sign-up and within the in-app billing area. Subscription tiers renew automatically until cancelled. Pay-per-letter fees are charged at the time each letter is generated. Beyond the three-business-day CROA cancellation right described in Section 4, refunds are governed by the refund terms posted in your billing area at the time of purchase. You authorize Vindex Intelligence and its payment processors to charge the payment method on file for all fees you incur.
9. Privacy and Credit-File Data
Your credit-file data is sensitive. We handle it in accordance with our Privacy Policy. You consent to our use of your data to provide the Service, including transmission to consumer reporting agencies and the United States Postal Service for the purpose of delivering your dispute correspondence.
10. Disclaimer of Warranties
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, Vindex Intelligence disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade. Vindex Intelligence does not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.
11. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall Vindex Intelligence, its affiliates, officers, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, data, goodwill, or credit opportunities, arising out of or related to your use of or inability to use the Service, even if advised of the possibility of such damages. The aggregate liability of Vindex Intelligence for any and all claims relating to the Service shall not exceed the greater of (a) the total fees you paid to Vindex Intelligence in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (US$100).
12. Indemnification
You agree to indemnify, defend, and hold harmless Vindex Intelligence and its affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with: (i) information you submit to the Service; (ii) statements made in dispute correspondence prepared based on your instructions; (iii) your violation of these Terms; or (iv) your violation of any law or third-party right.
13. Dispute Resolution and Governing Law
These Terms are governed by the laws of the State of [GOVERNING STATE], without regard to its conflict-of-laws principles, and by applicable U.S. federal law. Any dispute arising from or relating to these Terms or the Service shall be resolved exclusively by binding individual arbitration administered by [ARBITRATION FORUM, e.g., AAA or JAMS] under its then-current consumer rules, in [VENUE], except that either party may bring an individual action in small-claims court. Class actions and class-wide arbitration are not permitted. If the foregoing arbitration clause is found unenforceable, the parties consent to the exclusive jurisdiction of the state and federal courts located in [VENUE].
14. Termination
You may close your account at any time from your settings. Vindex Intelligence may suspend or terminate your access for violation of these Terms, suspected fraud, non-payment, or as required by law. Upon termination, Sections 5, 9, 10, 11, 12, and 13 survive.
15. Changes to these Terms
Vindex Intelligence may update these Terms from time to time. Material changes will be communicated by email or in-app notice at least thirty (30) days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
16. Severability and Entire Agreement
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. These Terms, together with our Privacy Policy and Service Disclaimer, constitute the entire agreement between you and Vindex Intelligence regarding the Service.
